What Georgia Law Defines as Drug Trafficking

Under OCGA 16-13-31, drug trafficking is a felony triggered by the weight of a controlled substance, not by evidence of a sale or distribution plan. That distinction is critical. Trafficking covers cocaine, methamphetamine and amphetamine, marijuana, opiates including heroin, morphine, and opium, and fentanyl, which was added to Georgia’s trafficking statute under the Fentanyl Eradication and Removal Act effective July 1, 2025. The weight thresholds that convert a possession case into a trafficking charge are specific:

Trafficking weight thresholds under OCGA 16-13-31:

Cocaine and methamphetamine/amphetamine: 28 grams or more
Heroin, morphine, and opium: 4 grams or more
Fentanyl and related substances: 4 grams or more
Marijuana: more than 10 pounds

Because no proof of intent to sell is required, a person found in proximity to a controlled substance at or above these weights faces a trafficking charge regardless of their stated purpose. That’s a meaningful departure from how most drug offenses are graded, and it means the defense has to work differently from the start.

Trial Experience That Matches High-Stakes Charges

Drug trafficking cases are tried in Superior Court, where the penalties are severe and the procedures are formal. Attorney Chester J. Gregg has conducted over 1,000 bench trials in state courts and brings extensive jury trial experience across military, federal, and state proceedings. Attorney A.J. Balbo has represented clients in some of the most closely watched federal cases in the country, including the federal trial stemming from the Ahmaud Arbery shooting and a case connected to the January 6th events at the U.S. Capitol. Mandatory Minimum Sentences Under OCGA 16-13-31

Once a trafficking conviction is entered, Georgia courts generally can’t suspend, probate, or reduce the sentence below the statutory floor. The mandatory minimums rise sharply with weight.

Cocaine and methamphetamine/amphetamine mandatory minimums:

28 to 199 grams: 10-year minimum, $200,000 fine
200 to 399 grams: 15-year minimum, $300,000 fine
400 grams or more: 25-year minimum, $1,000,000 fine

Heroin, morphine, and opium mandatory minimums:

Sentences begin at 5 years for quantities between 4 and 13 grams and increase with weight

Fentanyl mandatory minimums:

Under the Fentanyl Eradication and Removal Act, sentences begin at 10 years for quantities of 4 grams or more and rise to a 35-year mandatory minimum with a $750,000 fine for 28 grams or more

Marijuana mandatory minimums:

Above 10 pounds: 5-year minimum
2,000 pounds or more: 7-year minimum
10,000 pounds or more: 15-year minimum

Two narrow exceptions allow defendants to seek a sentence below these floors. The first is a statutory safety valve available to defendants who had no leadership role in the offense, possessed no weapon or dangerous object, caused no death or serious injury to a non-participant, and carry no prior felony conviction. The second is a prosecutor’s motion based on substantial assistance provided to law enforcement. Neither path is simple, and both require careful legal strategy from the outset.

How a Hinesville Trafficking Case Moves Through the Courts

Initial arrest warrant applications and probable cause hearings are handled at the Liberty County Justice Center, where the Magistrate Court operates. Because trafficking is a felony, though, bond can’t be set on a preset schedule by a magistrate. A Superior Court judge must set bond on a trafficking charge. Getting in front of the right court quickly matters, and having attorneys with Superior Court felony experience at the bond hearing can affect how long a client remains held before trial.

How We Approach the Defense in a Trafficking Case

Because trafficking liability turns on weight, the quantity and purity reported by lab testing are central contested facts in nearly every case. The Equal Access Rule

When drugs are found in a shared location such as a vehicle, home, or storage space, the equal access rule may be available. It allows the defense to argue that others had access to the area where the controlled substance was found, which undermines the prosecution’s claim of knowing possession. The rule doesn’t apply where the state alleges joint constructive possession among multiple people, so its availability depends on the facts of each case.
