What Georgia Law Defines as Drug Trafficking
Under OCGA 16-13-31, drug trafficking is a felony triggered by the weight of a controlled substance, not by evidence of a sale or distribution plan. That distinction is critical. Trafficking covers cocaine, methamphetamine and amphetamine, marijuana, opiates including heroin, morphine, and opium, and fentanyl, which was added to Georgia’s trafficking statute under the Fentanyl Eradication and Removal Act effective July 1, 2025. The weight thresholds that convert a possession case into a trafficking charge are specific:
Trafficking weight thresholds under OCGA 16-13-31:
- Cocaine and methamphetamine/amphetamine: 28 grams or more
- Heroin, morphine, and opium: 4 grams or more
- Fentanyl and related substances: 4 grams or more
- Marijuana: more than 10 pounds
Because no proof of intent to sell is required, a person found in proximity to a controlled substance at or above these weights faces a trafficking charge regardless of their stated purpose. That’s a meaningful departure from how most drug offenses are graded, and it means the defense has to work differently from the start.
