Under O.C.G.A. § 40-6-391(k)(1), a driver under 21 is subject to the underage DUI provision if their alcohol concentration is .02 grams or more while operating or in actual physical control of a moving vehicle. That threshold is far lower than the .08 standard that applies to adult drivers. The specific charging language on the citation matters because a case may involve the under-21 per se provision, an impairment theory, or both, and each carries different legal considerations.

Criminal Court & DDS Proceedings Move Separately

Following an arrest, two separate legal matters run on parallel tracks:

  • Criminal Case: Handled in McIntosh County court. Depending on the person’s age, charge, and case posture, the matter may proceed in State Court or Juvenile Court. The appropriate court is a question that requires case-specific review.
  • DDS License Action: Handled administratively by the Georgia Department of Driver Services, separate from the criminal proceeding and governed by its own procedures and deadlines.

License Consequences for Underage DUI in Georgia

The DDS consequences for an underage DUI are distinct and, in some categories, particularly restrictive. According to Georgia DDS, a first suspension for a driver under 21 with a BAC of .02 to below .08 carries a minimum six-month suspension with no eligibility for a limited driving permit. A BAC of .08 or above, or a refusal to submit to testing, carries a minimum 12-month suspension, also with no limited driving permit available in that category. The applicable suspension depends on the BAC result or refusal and the specific DDS notice received.

A total loss of driving privileges can affect a young person’s ability to get to school, work, treatment programs, or family obligations. For military families, it can also complicate access to base or other service-related responsibilities.
