Georgia law is one of the toughest in the nation regarding repeat DUI offenders. Under O.C.G.A. § 40-6-391, the penalties escalate sharply based on the number of prior convictions within a ten-year lookback period (measured from the date of arrest).

  • License Action: 5-year revocation, including a 2-year “hard” suspension
  • Other Requirements:
    • Declared a Habitual Violator
    • Mandatory IID
    • 30 days of Community Service
    • Public notice of conviction (published in local newspaper)

4th DUI (Felony, within 10 years)

  • Confinement: 1–5 years in State Prison (minimum 90 days served)
  • Fine: $1,000–$5,000
  • License Action: Permanent License Revocation
  • Other Requirements:
    • Mandatory IID
    • 60 days of Community Service
    • Five years of probation
