DUI
When charged with Driving Under the Influence (DUI) or any other alcohol-related offense, it is vital that you seek experienced legal representation immediately. MILITARY JUSTICE
The Uniform Code of Military Justice (UCMJ) applies to active duty servicemembers at all times and locations, whether on or off duty. Therefore, the military has jurisdiction to prosecute a servicemember if (1) the servicemember is on active duty, and (2) an offense triable by court-martial has been committed.
According to the UCMJ and other regulations, servicemembers are entitled to legal advice when facing court-martial, non-judicial punishment, and administrative separations. Although servicemembers are entitled to free representation by qualified and competent judge advocates, they are also permitted to retain civilian lawyers in addition to their military counsel at no cost to the government. In other words, the servicemember must pay the civilian attorney out of pocket.
Before hiring a civilian lawyer, a servicemember should consider their options carefully. The servicemember should also appreciate the military justice system contains a number of procedures and protections that have few civilian equivalents. Moreover, most civilian attorneys have never practiced before a military court.
